10. WHAT DEFINES THE EB-5 INVESTMENT PROGRAM?

The EB-5 Investment Visa Category is for foreign investor entrepreneurs who want to gain a Visa through the EB-5 program, also known as the Immigration Act of 1990. 

The general prerequisite is the foreign investor will "invest or be active in the process of investing," the minimum capital of $1 million dollars, or in some cases $500,000. The investment should be a "new or existing business enterprise" that is "at risk" and can create 10 full-time positions for a two year period. After this time, the investor will earn a personal permanent resident status, as well as for family members under the age of 21.
