People obtaining a green card via the EB-5 investment program will receive a conditional green card that is good for two years. Likewise, spouses who have been married to a green card holder for less than two years will receive a conditional green card that will expire after two years.
In the last 90 days of this two year period the card holder should request conditions be removed. If approved, the foreigner will now have an unconditional green card. If the foreigner does not apply within the right time period they should contact legal counsel for advice.
Failure to have the conditions removed will result in an invalid green card and the status of permanent resident will be removed.
Unconditional green cards expire after 10 years, but this does not mean a change in status. After the 10 years the foreigner will have to apply via a I-90 form for a new green card. If a green card is not to-date, foreigners will not be able to travel out of U.S. boundaries or use the card for evidence of being permitted to work.
